Google’s Street View has 35 days to erase wifi information.

While taking pictures during its Street View service, Google “mistakenly collected” data from local wifi networks and has 35 days to remove any remaining data or Google will face criminal proceedings. However as of yet the UK Information Commissioner’s Office has not imposed a fine. After further revelations about data it took last year from wifi networks an investigation was reopened against Google.

During the investigation more discs with additional private data were found. Google originally promised that they would destroy all the data it had collected but confessed that last year it had “accidentally” kept the additional discs. The ICO has notified Google that they must tell the Commissioner’s Office if they find any additional discs of information. The office’s head of enforcement said that, “Today‘s enforcement notice strengthens the action already taken by our office, placing a legal requirement on Google to delete the remaining payload data identified last year within the next 35 days and immediately inform the ICO if any further discs are found, and failure to abide by the notice will be considered as contempt of court, which is a criminal offense.”

But unlike the authorities in the United States the Information Commissioner’s Office stated that it would not fine Google. The office stated that “the detriment caused to individuals by this breach fails to meet the level required to issue a monetary penalty.” The ICO stated that the data it collected in 2010 was because of “procedural failings and a serious lack of management oversight”, however it agreed with Google’s claim that the company didn’t order this action from a corporate level. Google said in a statement on Friday: “We work hard to get privacy right at Google. But in this case we didn’t, which is why we quickly tightened up our systems to address the issue. The project leaders never wanted this data, and didn‘t use it or even look at it. ”We co-operated fully with the ICO throughout its investigation, and having received its order this morning we are proceeding with our plan to delete the data.“
